Shipping Insurance Terms and Conditions

In the United States, SECURSUS.COM has partnered with Hylant Group, Inc., a licensed insurance producer based in the United States, to place coverage in accordance with insurance regulations in each state. All insurance products are offered strictly within applicable state licensing regulations and the availability of coverage may vary based on jurisdictional requirements.

The insurer under this contract is N2G Worldwide Insurance Services, LLC.


Article 1 – Definitions

To interpret these insurance Terms & Conditions (from now on, the "T&C"), the following definitions apply:

  • Brand New Merchandise(s): any Items in new condition subject to a sales contract of which the seller is a professional;
  • Business(es): any natural or legal person, public or private, who acts for purposes falling within the scope of his commercial, industrial, craft, liberal, or agricultural activity, including when acting in the name or on behalf of another professional;
  • Carrier: any air or land Carrier, or the Postal Service;
  • Compensation: amount paid by the Insurer or Figural USA Inc to the Customer who has been the subject of an Incident;
  • Customer: any Individual or Professional, Shipper, or Recipient using Shipping Insurance;
  • Delivery: the physical handover of the Package or the Item to its Recipient;
  • Exclusions: list of Goods excluded by their nature defined in Article 4.3;
  • Figural USA Inc: an insurance intermediary company with its registered office at 2125 Biscayne Blvd. Ste 204 #23968, Miami, FL 33137, United States;
  • Incident: total or partial theft, damage, or non-delivery of the Items;
  • Individual(s): any natural person shipping items they personally own and are selling privately, not in the course of any commercial activity;
  • Insurer: N2G Worldwide Insurance Services, LLC, the insurance company providing the Shipping Insurance;
  • Item: any movable object that is not listed in the exclusions list (4.3);
  • Package(s) or Parcel(s): a single Item or several Items, regardless of weight, size, or volume, constituting an identifiable unit load when handed over to the Carrier, excluding pallets;
  • Shipping Insurance: the insurance contract covering the carried Items, provided by the Insurer, and available only from Figural USA Inc through the Secursus platform;
  • Pick-Up Date or Collection Date: the date on which the Package or the Items are handed over to the Carrier;
  • Recipient: the person mentioned on the shipping label as the recipient of the Package or Item, who is also the person mentioned on the proof of value;
  • Second-Hand Merchandise(s): any Items in a used condition that are bought or sold;
  • Service(s): insurance intermediary services provided by Figural USA Inc;
  • Shipper or Sender: person mentioned as being the Sender of the Package or the Goods on the Shipping Label and in the form completed by the Customer when subscribing to the Shipping Insurance;
  • Website: the website www.secursus.com.

Article 2 – Purpose, Scope, and Product Disclosure

These General Terms and Conditions define the contractual relationship between Figural USA Inc and its Customers (Individuals or Businesses).

Shippers and Recipients must be distinct physical or legal entities. A physical person representing a legal entity is not considered distinct from that entity.

For Individual Shippers, Shipping Insurance only covers Second-hand Merchandise. These Shippers must not engage in commercial activities as defined under applicable U.S. commercial law.

Shipping Insurance is reserved for natural persons aged 18 or older at the time of subscription.

Customers must verify that the transport protection applies to their shipment. Figural USA Inc is available in advance to pre-validate a protection request.

To validate the subscription, the Customer must complete the insurance form by providing accurate information, such as the value of the Package, the tracking number, the name of the Carrier, and the territorial scope of the shipment. Any inaccurate information will result in the forfeiture of coverage.

These Terms apply to all subscriptions to Shipping Insurance and are accessible at any time on our Website. They take precedence over any contradictory documents. By validating the subscription, the Customer accepts these Terms and the Website's General Terms of Use.

Article 3 – Territorial Scope of the Shipping Insurance

3.1. Countries Covered by the Shipping Insurance

The following countries are covered in full, including domestic and international shipments: the United States, all European countries, and the United Kingdom. Only international shipments will be covered for the following countries: Canada, Japan, South Korea, Switzerland, Singapore, Australia, Hong Kong, Norway, New Zealand, and Israel.

3.2. Countries Excluded from the Shipping Insurance

The following countries are explicitly excluded from coverage, regardless of whether they be the country of origin or destination: any countries subject to embargo as well as any country where the execution of the Shipping Insurance would cause Figural USA Inc or the Insurer to incur a sanction, prohibition, or restriction as a result of a resolution passed by the United Nations and/or as a result of economic or trade sanctions provided for by the laws or regulations of the United States of America, the European Union, or any other applicable national law formalizing such measures. The following countries are explicitly excluded: Afghanistan, Belarus, Burma, Cuba, North Korea, Iraq, Iran, Russia, Syria, Ukraine, Venezuela, and the entire African continent.


Article 4 – Items Covered by the Shipping Insurance

4.1. The Shipping Insurance covers all new and used Items except those listed in the exclusion list (4.3).

4.2. Here are some examples of Items covered by Shipping Insurance:

  • jewelry, pearls, and precious stones, watches;
  • goldsmithing, collector coins;
  • leather goods;
  • works of art or collectible Items, collector's stamps;
  • handicrafts;
  • high-tech Items;
  • clothing, shoes, and fashion accessories;
  • sporting goods (including bicycles);
  • books, magazines, posters;
  • medicines that do not require controlled temperature.

This list is not exhaustive. Shipping Insurance will cover all Items that are not on the exclusion list (4.3). Once entrusted to a Carrier, the above-mentioned Items are covered by Shipping Insurance, provided that the Customer has complied with the obligations outlined in Article 8, and that the total declared value of the Package does not exceed the amount declared to Figural USA Inc.

4.3. THE FOLLOWING, GIVEN THEIR NATURE, ARE NOT WITHIN THE SCOPE OF THE SHIPPING INSURANCE:

  • ALIVE ANIMALS;
  • MERCHANDISE TRAVELING UNDER CONTROLLED-TEMPERATURE CONDITIONS (POSITIVE OR NEGATIVE);
  • MANUFACTURING OR PRODUCTION EQUIPMENT;
  • ITEMS SHIPPED IN BULK BY SEA OR RIVER;
  • BANKNOTES, COUPONS, SECURITIES, CHECKS, CURRENCIES, PURE PRECIOUS METALS;
  • FURS, SKINS, LEATHERS;
  • FURNITURE OR ITEMS BEING MOVED;
  • CONTAINER BODIES;
  • COMMODITIES FALLING WITHIN THE SCOPE OF TRADING IN RAW COMMODITIES;
  • MERCHANDISE CLASSIFIED AS DANGEROUS BY THE CONVENTIONS, LAWS, OR REGULATIONS IN FORCE;
  • WEAPONS AND FIREARMS, WITHOUT EXCEPTION, IN COMPLIANCE WITH APPLICABLE FEDERAL AND STATE REGULATIONS;
  • TOBACCO, CIGARETTES, ALCOHOL, ANY GOODS CONTAINING CBD;
  • OBJECTS OR ART OBJECTS MADE OF GLASS, PORCELAIN, CERAMICS, EARTHENWARE, CRYSTALWARE, MIRRORS, VASES, POTTERY, CROCKERY, AND TV AND COMPUTER SCREENS. FIGURAL USA INC MUST VALIDATE THE PACKAGING OF THESE GOODS BEFORE SHIPPING TO BE INSURED.

4.4. The Shipping Insurance is limited to $120,000 (one hundred and twenty thousand dollars) per Package and per day for shipments to the same Carrier, regardless of the number of Packages. Figural USA Inc is willing to consider specific Customer requests for Items or Packages of a higher value.

4.5. The Shipping Insurance also covers returned Items, provided that the Items are, when returned, whole, merchantable, and properly packaged in accordance with the requirements set forth in Article 8.1 below, and that the Shipping Insurance covered the same Items during the initial (outgoing) shipment.


Article 5 – Duration of Coverage of the Shipping Insurance

5.1. For Items entrusted to a Carrier, the Shipping Insurance enters into effect at the moment when the insured Items, packaged per the requirements set out in Article 8, are handed over to the Carrier and ends upon Delivery to the Recipient against receipt, or at the latest 14 (fourteen) days from the Pick-Up Date, regardless of the means of transportation.

5.2. For returned Items, the Shipping Insurance terminates 14 (fourteen) days after the initial Pick-Up Date, regardless of the means of transportation. Items delivered and then returned to the Sender are not covered by Shipping Insurance unless agreed in writing by Figural USA Inc.


Article 6 – Types of Risks Covered by the Shipping Insurance

6.1. Shipping Insurance covers loss, complete theft, partial theft, or damages caused to the Items during transit.

6.2. THE SHIPPING INSURANCE DOES NOT COVER:

  • RUST AND OXIDATION ON ITEMS SHIPPED WITHOUT PROPER WRAPPING/PACKAGING;
  • THE FUNCTIONAL BREAKAGE OF ITEMS OR DISRUPTION/MALFUNCTION OF ANY ITEMS WITH ONE OR SEVERAL MECHANICAL, ELECTRICAL OR ELECTRONIC MECHANISMS NOT RESULTING FROM AN INCIDENT DURING TRANSIT;
  • DEPRECIATION;
  • LOSS OF DATA RECORDED ON MAGNETIC MEDIA;
  • SCRATCHES, SCUFFS, DEFORMATION, AND OTHER COSMETIC DAMAGE;
  • PRE-EXISTING WEAR AND TEAR ON SECOND-HAND ITEMS;
  • LOSSES OR DAMAGES ON PACKAGES RECEIVED WITHOUT SIGNATURE ARE COVERED UP TO A MAXIMUM OF $200 (TWO HUNDRED DOLLARS) PER PACKAGE. ANY AMOUNT EXCEEDING THIS LIMIT WILL NOT BE ELIGIBLE FOR COMPENSATION;
  • RISKS RELATED TO ELECTROMAGNETIC, BIOCHEMICAL, BIOLOGICAL OR RADIOACTIVE CONTAMINATION, OR CHEMICAL WEAPONS;
  • NUCLEAR RISKS;
  • CYBER RISKS;
  • ITEMS THAT ARE ALREADY BROKEN OR WEAKENED (UNLESS APPROVED BY FIGURAL USA INC IN WRITING);
  • ITEMS SHIPPED ON A PALLET (UNLESS APPROVED BY FIGURAL USA INC IN WRITING);
  • ITEMS SOLD OR PURCHASED ON AN ONLINE MARKETPLACE BY INDIVIDUALS. ONLY REGISTERED BUSINESSES WILL BE COVERED UNLESS APPROVED IN WRITING BY FIGURAL USA INC.

6.3. THE FOLLOWING EXCEPTIONAL EVENTS ARE NOT COVERED BY THE SHIPPING INSURANCE:

  • CONFISCATION, ATTACHMENT, REQUISITION, BLOCKADE RUNNING, SMUGGLING, ANY ARREST OR COURT-ORDERED SEIZURE;
  • WILLFUL MISCONDUCT OR GROSS NEGLIGENCE OF THE CUSTOMER OR ANY OTHER BENEFICIARY OF THE INSURANCE, REPRESENTATIVES OR OTHER AUTHORIZED PERSONS;
  • INHERENT VICE OF THE INSURED CARGO; WORM AND VERMIN UNLESS CAUSED BY CONTAMINATION DURING THE INSURED VOYAGE; EFFECT OF ATMOSPHERIC TEMPERATURE; ORDINARY LEAKAGE OR ORDINARY LOSS IN WEIGHT OR VOLUME;
  • ABSENCE OR INADEQUACY OR UNSUITABILITY OF PREPARATION, PACKING, OR PACKAGING;
  • WAR OR CIVIL WAR, HOSTILITIES, REPRISALS, TORPEDOES, MINES, AND ALL OTHER WEAPONS OF WAR, AS WELL AS ACTS OF SABOTAGE OR TERRORISM OF A POLITICAL NATURE OR RELATED TO WAR;
  • CAPTURE, ARREST, SEIZURE, RESTRAINT, OR DETENTION BY ANY GOVERNMENT OR AUTHORITY;
  • RIOTS, CIVIL COMMOTION, STRIKES, LOCKOUTS, AND OTHER SIMILAR EVENTS;
  • PIRACY OF A POLITICAL NATURE OR RELATED TO WAR.

6.4. NO INSURER SHALL BE DEEMED TO PROVIDE COVER, AND NO INSURER SHALL BE LIABLE TO PAY ANY CLAIM OR PROVIDE ANY BENEFIT HEREUNDER TO THE EXTENT THAT THE PROVISION OF SUCH COVER, PAYMENT OF SUCH CLAIM, OR PROVISION OF SUCH BENEFIT WOULD EXPOSE THAT INSURER TO ANY SANCTION, PROHIBITION OR RESTRICTION UNDER UNITED NATIONS RESOLUTIONS OR THE TRADE OR ECONOMIC SANCTIONS, LAWS OR REGULATIONS OF THE UNITED STATES OF AMERICA, THE EUROPEAN UNION, OR ANY OTHER APPLICABLE NATIONAL LAW IMPOSING SUCH MEASURES.


Article 7 – Approved Carriers and Delivery Methods

7.1. For Shipping Insurance to be valid, the Package must be insured and shipped directly by the Shipper. The insurance must be purchased no later than the day of shipment (until midnight). It can, however, be arranged earlier if the Shipper already has the tracking number.

The insurance is not valid if a third party, other than the Shipper, insures or ships the Package. Additionally, Packages insured by the Recipient are not covered unless there is prior written consent from Figural USA Inc.

7.2. The Shipping Insurance applies to Packages shipped with an adult signature or direct signature of the Recipient. Coverage ends when the Package is marked as delivered by the Carrier's tracking system.

In the event that a Package is shipped without the signature upon delivery option, Shipping Insurance coverage will be strictly limited to a maximum of $200 (two hundred dollars) per Package. No Compensation exceeding this amount will be payable for Packages delivered without a confirmed signature.

7.3. Items entrusted to a river or sea carrier are not covered by Shipping Insurance.

7.4. The Shipping Insurance does not apply to Items shipped to or from third-party retail locations acting as drop-off points (such as grocery stores, pharmacies, or any non-dedicated shipping outlets) unless approved by Figural USA Inc in writing. Coverage applies exclusively to Packages dropped off at or picked up from locations fully dedicated to shipping and carrier operations, such as standalone UPS Store locations, FedEx Office stores, or equivalent carrier-operated facilities. Packages may also be picked up by the Carrier directly from the Customer's home or business address.


Article 8 – The Customer's Obligations

The Shipping Insurance will not apply if the Customer does not meet all the following requirements:

8.1. Requirements Relating to the Packaging of the Items

8.1.1. Requirements applicable when Items are handed over to an accepted Carrier:

  • The Items must be shipped inside rigid containers so the content cannot be deduced by touching the container. The shipping label must be affixed to the outside of the Package on a rigid surface.
  • The Goods must be properly packed using new, resistant double packaging. (Double packaging means the goods are first packed in a first container such as a cardboard box, bubble wrap, or cardboard envelope, then placed in a larger and rigid outer packaging.)
  • The Goods must be prepared, packed, and packaged appropriately according to their nature in order to withstand the risks of transport.
  • There must be no information on the packaging that could be used to deduce the nature or value of the Items. The customs form is not considered an indication of value and should be placed under the shipping label.
  • A photograph of the Package as well as of the Package's contents must be taken before each shipment.

8.1.2. Rules About Damaged Items

If the Package arrives damaged or altered, the Customer must notify the Carrier immediately of any visible damage before signing the delivery receipt, or within 24 hours of delivery if immediate notification was not possible, and submit photographic evidence to Figural USA Inc within that same timeframe. If the Customer signs the delivery receipt without noting any damage, the Customer accepts the Goods and waives any claim. If the Package is accepted by the Recipient, it is deemed to have been Delivered without damage or missing Items.

8.1.3. Special Rule Regarding Non-Resistant Packaging

Non-rigid packaging such as bubble envelopes or thin cardboard envelopes will be covered for a maximum value of $200 (two hundred dollars) per Package.

8.2. Shipping Requirements for Insured Merchandise

Merchandise or Packages must be shipped using the signature upon delivery option. If Merchandise or Packages are shipped without this option, coverage will be strictly limited to $200 (two hundred dollars) per Package as set forth in Article 7.2.

The Shipping Label must be attached to the Package and include all the following information:

  • For the Shipper: full name or business name and complete address (street, number, postal code, city, state, country).
  • For the Recipient: full name, complete address (street, number, postal code, city, state, country), and phone number.

Any false information listed on the Shipping Label will void the insurance coverage. If the Shipper or Recipient agrees with the Carrier to deliver the Package without signature, to a third party, to a mailbox, or to any unsecured location, coverage will be limited to $200 (two hundred dollars) per Package.

However, if the delivery without a signature results from the Carrier's negligence and not an agreement with the Shipper or the Recipient, Shipping Insurance remains valid. The Customer must provide all necessary evidence to demonstrate the Carrier's negligence.

8.3. Declared Value Requirements

The Customer must declare the value of the Merchandise contained in the Package when subscribing to Shipping Insurance. The insured amount must exactly match the value stated on the invoice.

In the event of a claim, this value must be justified by evidence that reflects an actual financial transaction between the Shipper (as seller) and the Recipient (as buyer). Proof of value will only be accepted if it demonstrates that a real payment was made by the Recipient to the Shipper for the declared amount:

  • For Brand New Merchandise: A commercial sales invoice dated less than two (2) months from the Pick-Up Date, matching the insured amount, accompanied by proof of payment (credit card receipt, bank transfer confirmation, or equivalent) confirming that the Recipient has paid the Shipper for the declared amount.
  • For Second-Hand Merchandise: A sales invoice or written sale agreement stating the value of the Merchandise, dated less than two (2) months from the Pick-Up Date, accompanied by proof of payment confirming that the Recipient has paid the Shipper for the declared amount.

Shipments between related parties, family members, or any parties where no financial transaction has taken place are not eligible for coverage. In the absence of verifiable proof of payment, Figural USA Inc reserves the right to deny or reduce any Compensation claim.


Article 9 – Compensation Value in Case of Claims

9.1. The value of the Merchandise serving as the basis for Compensation is equal to 100% of the value declared by the Customer when subscribing to Shipping Insurance. This value must be corroborated by the admissible evidence outlined in Article 8.3.

9.2. The total Compensation amount cannot exceed the declared value of the insured Merchandise. In the event of a claim, if the Customer receives Compensation or reimbursement from the Carrier, it will be deducted from the Compensation paid by Figural USA Inc. The Customer may not profit by receiving Compensation from both the Carrier and Figural USA Inc.


Article 10 – Reimbursement of a Claim

10.1. In the event of a claim, the Customer must:

  • Take precautionary measures to protect the insured Items and limit damage;
  • Retain all rights and legal recourse options against the Carriers and/or any third party assumed to be responsible;
  • In case the Package arrives damaged: notify the Carrier immediately and note the damage on the delivery receipt before signing, or within 24 hours of delivery if immediate notification was not possible;
  • Take a picture of the Package and its content;
  • Keep all damaged packaging;
  • In the case of theft, file a complaint with the relevant law enforcement authorities.

10.2. The Customer must provide Figural USA Inc with the following documents without delay and, at the latest, within 14 (fourteen) days from the Pick-Up Date or 3 (three) days from the Delivery Date, without any photo editing, retouching, or modifications:

  • A copy of a government-issued identity document and/or the company's registration certificate or an equivalent unique identification number;
  • The Shipping Label;
  • Proof of the insured value of the Merchandise, as per Article 8.3, consisting of both (i) a sales invoice and (ii) proof of payment (credit card receipt, bank transfer confirmation, or equivalent) establishing that a financial transaction took place between the Shipper and the Recipient for the declared amount. Invoices without corresponding proof of payment will not be accepted;
  • A copy of the claim filed with the Carrier, along with any responses or tracking confirmation received from them;
  • A photo of the damaged Package or showing the missing Merchandise;
  • A photo of the Package taken by the Shipper before the Pick-Up Date, including the Merchandise covered by the insurance;
  • In case of loss: a written confirmation from the Carrier that the Package has been declared lost;
  • In case of theft: a copy of the police report filed with the competent authorities;
  • In case of damage: a repair estimate provided by a qualified professional, submitted to Figural USA Inc for prior approval.

In case of doubt or inconsistencies, Figural USA Inc reserves the right to request additional documentation in accordance with applicable anti-money laundering regulations.

10.3. In the event of an Incident, the Customer must file a claim through their Secursus account using the dedicated interface. Only claims submitted via this interface will be considered valid. The claim must be submitted without delay and, in any case, within a maximum of 14 (fourteen) days from the Pick-Up Date or 3 (three) days from the Delivery Date, whichever comes first. Failure to do so will result in the forfeiture of any insurance coverage.

10.4. Figural USA Inc will support the Customer in processing its claim and will serve as the Customer's direct point of contact throughout the process.

10.5. In case of non-delivery, the Customer must provide a copy of the claim submitted to the Carrier and the Carrier's response or tracking confirmation establishing that the Package has been declared lost, and give a written undertaking to accept any Package subsequently found and to reimburse the Insurer accordingly.


Article 11 – Options of Recourse against Carriers

In all cases, the Insurer is subrogated in the rights of the Customer as regards undertaking actions of recourse against Carriers or any third parties assumed to be responsible.


Article 12 – Pricing, Payment Terms, and Cancellation

12.1. The price of Shipping Insurance is calculated based on the declared value of the Package and the Customer's location. The real-time price is displayed on the Website before subscription.

12.2. The amount is payable in full at the time of subscription through a secure payment system. Accepted payment methods include Visa, MasterCard, American Express, and other major credit and debit cards.

12.3. The Customer may cancel their Shipping Insurance for a full refund within 14 (fourteen) days of purchase, provided the Package has not yet been picked up by a Carrier. Once the Package has been picked up by the Carrier, the Shipping Insurance takes immediate effect and is neither cancellable nor refundable.


Article 13 – Liability and Fraud

13.1. Liability

Each party assumes the consequences arising from its own faults and breaches of obligations; there is no joint liability between the parties. The total liability of Figural USA Inc shall not exceed $120,000 (one hundred and twenty thousand dollars) per Package and per day for shipments to the same Carrier, regardless of the number of Packages.

13.2. Fraud

Shipping Insurance does not cover claims resulting, directly or indirectly, from fraud, dishonesty, or negligence, including but not limited to credit card fraud, check fraud, mail fraud, wire fraud, or any other form of fraud by the Shipper, Recipient, or their employees.

If Figural USA Inc has a legitimate doubt regarding the good faith of the Customer, Shipper, or Recipient, it reserves the right to initiate an internal investigation and request any documents or records necessary to establish good faith. All submitted documents will be verified for alterations or modifications.

If doubt persists following the investigation, Figural USA Inc may:

  • Suspend the Customer's account;
  • Suspend the Compensation claim;
  • Refer the matter to the appropriate law enforcement authorities and/or initiate civil or criminal proceedings.

Fraudulent insurance claims may constitute insurance fraud under applicable federal and state laws, including but not limited to 18 U.S.C. § 1341 (mail fraud) and 18 U.S.C. § 1343 (wire fraud), and may be subject to significant criminal and civil penalties.

As part of its anti-fraud procedures, Figural USA Inc thoroughly investigates all first-time claims to detect fraudulent activity.


Article 14 – Force Majeure

Neither Figural USA Inc nor the Customer shall be held liable for any failure or delay in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, strikes, or other events constituting force majeure under applicable law. The party invoking force majeure must promptly notify the other party in writing and provide appropriate documentation.


Article 15 – Personal Data

Figural USA Inc collects and processes personal data in accordance with applicable U.S. federal and state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and equivalent state privacy regulations. Figural USA Inc is committed to protecting the security and confidentiality of Customer data and will not share it with third parties except as necessary to provide the Services (including sharing with the Insurer) or as required by law. Customers have the right to access, correct, or request deletion of their personal data by contacting Figural USA Inc at contact@secursus.com.


Article 16 – Cookies

The Website uses cookies to ensure proper operation and improve the browsing experience. Customers will be informed of cookie usage and may manage their preferences through the cookie settings available on the Website.


Article 17 – Applicable Law and Jurisdiction

These T&Cs and all related insurance transactions are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute not resolved through the process outlined in Article 18 shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.


Article 18 – Dispute Resolution

18.1. General Provisions

In the event of a dispute arising from these Terms and Conditions, the Customer is encouraged to first contact Figural USA Inc directly in writing at contact@secursus.com to seek an amicable resolution.

18.2. Arbitration

If the dispute cannot be resolved informally, both parties agree to submit to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Miami, Florida. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

18.3. Class Action Waiver

To the fullest extent permitted by applicable law, the Customer agrees to resolve disputes with Figural USA Inc on an individual basis only and waives any right to bring or participate in any class action or representative proceeding.


Article 19 – Pre-Contractual Information – Customer Acceptance

The Customer acknowledges having received, prior to subscription, a clear and understandable copy of these T&Cs, including information concerning:

  • the essential characteristics of the Service;
  • the cost of the Service;
  • the identity and contact details of Figural USA Inc;
  • the functionality of the digital platform;
  • the availability of arbitration in the event of a dispute.

By subscribing to the Service, the Customer fully accepts these T&Cs and agrees to pay for the ordered Services.
